Terms & Conditions
Please read these terms and conditions carefully. By making a purchase from Regatta Point Community Sailing, Inc. (RPCS) or its affiliates, either in person or on the website, or by using any RPCS service, you agree to be bound by the terms and conditions outlined below. These terms and conditions are subject to change at any time, without prior notice, at the sole discretion of RPCS. Any updates or amendments will be posted on our website at RegattaPoint.org. If you do not agree with these terms and conditions, please do not proceed with your purchase or using RPCS Services. No staff member is authorized to alter or amend these terms and conditions unless a written document is signed by the Board of Directors, Executive Director or an authorized Designee.


Age Requirements
Participant age is determined as of the start date of the program. These age requirements are established to prioritize the safety, well-being, and overall enjoyment of all participants, particularly children. Any violation of the stated age requirements may result in removal from the program without a refund. Regatta Point Community Sailing reserves the right to request proof of age at any time.

Age Requirement for Adults:
The age requirement for adults is that they are over the age of 18 when signing the membership application.  Youth over the age of 16 can register for adult programs with parental permission and signature. 


Boat Rentals, Charters and Usage:
To ensure safety on the water, Regatta Point Community Sailing requires that anyone renting a boat must be able to swim at least 75 yards and tread water for a minimum of three minutes. Individuals who are not confident in their swimming ability or are uncomfortable in the water are advised NOT to participate in boating activities.


The individual who rents a boat, or who brings guests on board, is fully responsible for their own safety as well as the safety of every member of their party, including minors. Adults aged 18 and older may rent and operate any boat independently. Young adults between 12- 17 need a parents signature on the float plan.  Participants aged 16 & 17 need a guardian's signature, all ages under 16 should need an adult on the water with them (same or different boat).
Boating boundaries vary by location and are clearly communicated by staff. If there is any uncertainty about the boundaries, renters are required to ask a staff member for clarification before departure.


All individuals on boats must wear properly fastened personal flotation devices (PFDs) at all times. Under no circumstances is it permitted to pick up passengers from the water, swim from the boat, or jump into the water during a rental. Alcohol or drug use before or during boat use is strictly prohibited. Regatta Point reserves the right to deny service to any individual suspected of being under the influence of alcohol or drugs.


Loud, unnecessary screaming or yelling is not permitted unless signaling distress. In the event of capsizing or if a person ends up in the water, individuals are instructed to hold on to the boat, which is designed to float and be highly visible, aiding in rescue.


All boating is undertaken at the participant’s own risk. While staff may respond to visible emergencies or assist when necessary under the protections of the Good Samaritan Law, they are under no formal obligation to intervene.


Violation of this policy can result in the revocation of the rental without a refund. 


Boats, Facility & Equipment Damage 
At Regatta Point Community Sailing, all renters are expected to treat boats and equipment with care and to follow all safety and usage rules. By renting equipment, individuals agree to be held financially responsible for any damage caused during their rental period that goes beyond normal wear and tear.


Damage Responsibility:
All renters are responsible for the condition of the boat, facility and its equipment during the time it is in their possession or use. Any damage resulting from misuse, negligence, or violation of safety rules will be the financial responsibility of the renter.


Damage Assessment:
Upon return, all equipment will be inspected by a staff member. If damage is identified, an immediate assessment will be made to determine the extent and nature of the damage.


Good Faith Estimate & Billing:
If damage is found, Regatta Point will provide a good faith estimate for repair or replacement costs. This estimated amount will be charged to the renter’s payment method on file before they leave the premises. A detailed breakdown of the charges will be made available to the renter upon request. Should the damage be more extensive than esteemed, the renter will pay that amount.  Regatta Point’s hourly fee for maintenance is based on the hourly service fee of marine repair services.  In 2025, that fee is $140 per hour.


Cancelation & Modification Policy - Regatta Point
RPCS reserves the right to cancel or modify any program, activity, or operation at any time, for any reason. This includes, but is not limited to, cancellations due to inclement weather, insufficient enrollment, low participation, safety concerns, or other operational or business-related factors.
 
In the event of a cancellation initiated by RPCS, we will make reasonable efforts to notify participants in a timely manner and provide appropriate options, which may include rescheduling, credit, or refund, depending on the circumstances.
 
Your safety and the sustainability of our programs remain our top priorities. We appreciate your understanding and flexibility as we work to provide the best possible experience on and off the water.


Cancelation Policy - Participant


Boat Reservation Cancellation Policy
To receive a full refund for a reserved boat rental, cancellations must be made at least 24 hours prior to the scheduled reservation time. Cancellations made at least 4 hours in advance but less than 24 hours before the reservation will be eligible for a credit toward a future rental. Cancellations made less than 4 hours before the scheduled booking are not eligible for a credit or refund.

Group Booking Cancellation Policy
To receive a full refund for paddling classes or group bookings, cancellations must be made at least 48 hours prior to the scheduled reservation. Cancellations made at least 4 hours in advance, but less than 48 hours before the class or event, will be eligible for a credit toward a future booking. Cancellations made less than 4 hours before the scheduled time are not eligible for a credit or refund.


Member Sailing Class - Cancelation Policy
The sailing classes are very popular and generally fill. We ask as a courtesy to other members to let us know as soon as possible  if you cannot attend the course so we can make it available to them. If you cannot attend a particular class, just let your instructor know or email us. To cancel the course or let us know you cannot attend a class please email us at info@regattapoint.org.


Member Boat Reservations - Cancelation Policy
As a courtesy to other members please let us know as soon as possible if you cannot make your reservation so we can make it available to them . If you need to cancel email us at info@regattapoint.org.   


All cancellation or rescheduling requests must be submitted by email to info@regattapoint.org.


Donation Policy
Regatta Point Community Sailing deeply values and appreciates all donations. Contributions directly support our mission by funding scholarships, helping to keep program costs affordable, and sustaining community-based programs and initiatives. Because donations are applied immediately to support these efforts, all donations are considered final and are non-refundable.


In the case of equipment donations, please note that Regatta Point Community Sailing, Inc. retains the right to use or sell donated equipment in a manner that best supports our programs and aligns with our nonprofit mission.


Guest Policy
Regatta Point Community Sailing welcomes guests when accompanied by an active member. However, we reserve the right to limit or restrict guest access at any time, at our sole discretion. This may include restrictions on the number of guests, specific amenities, or access during peak hours. Guest usage may be limited to designated family hours, open hours, or scheduled programs, and such restrictions may vary by location.


All adult guests are required to complete and sign a waiver/float plan prior to participation in a boating activity. This information may be used to monitor guest participation, as well as for marketing or communication purposes in accordance with applicable laws and permissions. In some cases, guests may also be required to meet with a staff member prior to utilizing the facilities.


The number of guests a member may bring is subject to the capacity of the boat and the certifications held by the member. Guests aged 17 or younger must be accompanied at all times by a sponsoring member who is at least 18 years old, or by another adult guest who is their parent or legal guardian.
For guests under the age of 12, a parent or legal guardian must complete a consent form prior to entry into the boathouse. These young guests must be accompanied at all times by either the sponsoring member or their own parent or legal guardian, who must remain present and actively supervising throughout the visit.

Fees, Dues & Billing Policies
Regatta Point Community Sailing collects fees including but not limited to membership dues, camp fees, team fees, boat storage fees, and rental fees for one time use and recurring service payments. These payments are processed via electronic funds transfer (EFT) from the bank account or credit/debit card designated on your membership account. In certain cases, a member may designate an alternative billing date for specific services. If we are unable to successfully process a payment, we will continue to attempt to collect the outstanding amount.


To prevent disruptions in service due to expired or reissued cards, Regatta Point may utilize card update services provided by financial institutions. Members may opt out of this automatic update feature by contacting the office directly. Regatta Point is not responsible for any overdraft fees resulting from EFT attempts. We do not issue monthly invoices. All members are required to maintain a valid EFT account to establish and sustain membership. If a member wishes to avoid an upcoming charge, they must provide an alternate method of payment no later than three business days before the end of the month. To update or change your payment method, please visit the Regatta Point office or RegattaPoint.org. Dues are subject to change without notice unless otherwise required by law. In the event of a change in dues or fees, any notice required by law may be provided via email or regular mail to the address on file.


Members may update or make changes to their membership in person, including changes to payment accounts, upgrades to membership levels, or adding or removing family members. These changes must be completed at the office and are not accepted via phone, email, fax, or online (unless explicitly permitted). Regatta Point may assess a change fee for adjustments to membership and will charge this either on the day of the change or during the next scheduled EFT. All fees are subject to change without notice.


The primary member on an account—usually the holder of the EFT account—has full authority to manage the membership, including canceling the membership, adjusting payment methods, modifying authorized users, and viewing payment or usage history. Partner members may also make some changes, such as removing members (except the primary member), adding youth participants, updating personal information, and reviewing their own usage history. Youth members under the age of 18 may not make changes or access account details.


Regatta Point allows for suspension or termination of memberships under specific conditions with advance written notice. A medical or military leave of absence may qualify for a temporary membership freeze. To request a freeze, a member must submit a written statement from a treating physician or a copy of official military orders. Once approved, Regatta Point will freeze the impacted portion of the membership for up to 90 days. Membership will automatically reactivate after this period unless an extension is requested and approved in advance. Regatta Point does not allow for retroactive freezes.


Members who hold long-term seasonal contracts are expected to fulfill the full term of the agreement. Early cancellation is not permitted without full payment of the membership balance. However, in cases of permanent disability, members may cancel their membership by providing written notice along with medical documentation. In the event of a member’s death, their estate may cancel the contract by submitting appropriate documentation.
Regatta Point also reserves the right to suspend or terminate a membership at any time due to non-payment, violation of policies or rules, or for conduct deemed inappropriate or contrary to the organization’s mission and values.


Information Security Policy
At Regatta Point Community Sailing, Inc., we are committed to protecting your privacy and safeguarding your personal information. All payment and personal data submitted through our website is secured using industry-standard Secure Sockets Layer (SSL) encryption technology. This ensures that sensitive information—such as your name, address, and credit card number—is protected and cannot be intercepted or read during transmission over the internet.
We may collect personal information for internal use, such as maintaining accurate records and improving our services. However, Regatta Point does not sell, share, or distribute your personal information to third parties. Your email address may be added to our mailing list so we can keep you informed about upcoming events, special offers, and promotions. You may opt out of these communications at any time by clicking the unsubscribe link included at the bottom of each email.


Injury Policy
I understand that participation in activities associated with RPCS, including watersports, is inherently dangerous and may test a person’s physical and mental limits. Such activities have the potential for death, serious injury and property loss to me or my ward, including but not limited to heat stroke, dehydration, sunburn, hypothermia, drowning, abrasions, contusions, muscle and other soft tissue strains and bruises, fractured bones, injuries to joints including knees, ankles and elbows, dislocations, concussions, and cardiovascular injuries including heart attacks and strokes. While the likelihood of serious injury is small, some of these injuries, by themselves or in combination, may lead to serious injury or even death.
 
If an injury occurs while you are on RPCS premises, it is essential that you notify a staff member immediately. Our team is trained to provide or coordinate appropriate medical assistance as needed. In the event of any injury, a staff member will also complete an incident report to document the situation accurately and ensure proper follow-up. Your safety is our priority, and prompt reporting helps us maintain a secure environment for all participants.
 
Participant Photograph Policy
By registering for programs at Regatta Point Community Sailing, Inc., participants and their legal guardians grant permission for photos and videos to be taken during activities for promotional, educational, or documentation purposes. These images may be used by Regatta Point or by third-party vendors who assist in administering our programs. From time to time, local media outlets may also feature program participants and may publish photos along with names in print or online coverage. If you do not wish for your child to be photographed or included in such media, you must indicate this preference on the program application at the time of registration.

 

Payment Policy
All payments, including any required deposits and remaining balances, must be completed in full prior to the delivery of services. Online registrations require the use of a valid credit card—Visa, MasterCard, or Discover. In-person payments are accepted via cash, money order, personal check, or credit card. Checks should be made payable to RPCS or Regatta Point Community Sailing, Inc. Returned checks are subject to a $35 fee, which must be paid by bank check or cash. Please note that class fees are not prorated under any circumstances.


Under special circumstances, as determined by the Executive Director or designee, payment plans may be created to meet financial circumstances of the purchaser. 

 

Payment & Refund Policy – Adult Memberships
All adult memberships at Regatta Point Community Sailing are non-refundable. Once a membership has been purchased, no refunds will be issued under any circumstances. In the case of a valid medical condition that prevents participation, a credit may be issued to extend the membership for the duration of the documented incapacity. This credit does not constitute a refund but allows for a deferred use of services.


Members enrolled in a payment plan are still contractually obligated to pay the full amount of the membership, regardless of usage. By signing up for a membership, you are agreeing to fulfill the full financial obligation outlined in your membership agreement. If you have questions or would like to review the terms of your specific agreement, please contact the office for assistance.


Members may upgrade their membership at any time by paying the difference in cost. For example, a 30-day membership may be upgraded to a full-season membership, or a single adult full-season membership may be upgraded to a double adult full-season membership.


Payment & Refund Policy – Youth Programs
All youth programs at Regatta Point Community Sailing include a non-refundable and non-transferable deposit equal to 50% of the total program fee. Full payment—whether by cash, check, or credit card—is required prior to the start of any program.


To be eligible for a partial refund, written notice of cancellation must be received at least 30 days before the program start date. In such cases, a refund will be issued for the amount paid, minus the 50% non-refundable deposit. No refunds will be given within one month of the program’s start date unless there is a verifiable medical emergency. In such instances, and with proper medical documentation, Regatta Point may issue a refund for the remaining tuition, excluding the 50% non-refundable portion.


Regatta Point reserves the right to cancel programs due to insufficient enrollment, in which case a full refund will be provided. The organization also reserves the right to discontinue participation, without refund, in the unlikely event of persistent disruptive behavior. Parents or guardians will be notified before such action is taken.
Payment plans are available for youth programs and are dependent on how early the participant is registered. Each week of camp is reserved with a 50% deposit. The remaining balance must be paid in full at least two weeks prior to the registered program start date. If a payment is declined, it is the responsibility of the parent or guardian to contact Regatta Point promptly to arrange payment and secure the camper’s spot.


Personal Belongings Policy
All personal belongings must be stored in a locker while on the premises of Regatta Point Community Sailing. It is the responsibility of each individual to ensure their locker is securely closed and locked before leaving it unattended. You must keep your locker key or combination with you at all times and never leave it unsecured. If you choose to use a combination lock, you are solely responsible for remembering both your locker number and combination.
Lockers are for day-use only and may not be used to store personal belongings overnight. Regatta Point strongly advises against bringing valuables such as watches, jewelry, or large sums of cash to the facility. Additionally, valuables should never be left in plain sight inside your vehicle, and you should always ensure your vehicle is securely locked.


Regatta Point Community Sailing is not liable or responsible for any lost, stolen, or damaged personal property, whether such loss occurs in a locker, vehicle, or elsewhere on the premises. If you believe you have lost an item, please visit the office to check for recovered items.


Registration Policy
All participants are required to submit a completed and up-to-date application prior to the start of their program at Regatta Point Community Sailing. When registering online, the application will be processed automatically as part of the registration process. For those registering over the phone or in person, a paper application may be completed instead. Paper copies are available upon request at the office. It is the participant’s responsibility to ensure that all information provided on the application is accurate and current at the time of submission.


Risk, Responsibility, and Safety Policy
The participant acknowledges that they have reviewed the current weather and water conditions and understand the risks associated with the planned activity. The participant confirms that they are comfortable floating or swimming in open water and understands that if they are not confident in their ability to do so, they should not participate in boating activities. This decision is left to the participant’s discretion.
The participant recognizes that watersports and outdoor activities involve inherent risks, including variable weather and water conditions, which may make boating difficult or dangerous. The participant understands that capsizing is a possible risk and agrees to move away from any perceived danger and alert others on the water if necessary.


The participant confirms that they have a basic understanding of maritime navigation rules and will remain within designated channels, following all posted and communicated safety guidelines and boundaries. Jumping or swimming from boats is strictly prohibited.


In the event of an injury, the participant authorizes the Company to seek medical assistance on their behalf and agrees to assume all related medical expenses. If the participant causes damage to Company property, they agree to pay the full replacement value. The Company is not responsible for lost, stolen, or damaged personal belongings, and participants are advised to secure personal items before participating.


Should the Company capture photographs of the participant during the activity, the participant authorizes the use of these images for marketing and promotional purposes. Finally, the participant certifies that they, or any dependent under their care, are in good physical health and capable of safely engaging in the physical activities required by boating and related programs.


Scholarship Policy
Regatta Point Community Sailing is committed to making its programs accessible to all. If a financial hardship exists, families may request a fee reduction by submitting a written request to the Executive Director. All scholarship inquiries and applications are handled confidentially. To begin the process, please contact the office directly to receive more information and obtain the necessary application materials. Please note that scholarship applications cannot be submitted or processed online at this time. Please see the entire scholarship police for more details. 


Purpose
Regatta Point Community Sailing is committed to making its programs accessible to everyone, regardless of financial circumstances. To ensure inclusivity and broad participation, Regatta Point offers need-based scholarships to individuals and groups who are unable to pay full program fees. All scholarship inquiries and applications are treated with the utmost confidentiality.


Application Process
Families, individuals, or group leaders experiencing financial hardship may request a fee reduction by submitting a written application to the Executive Director. To initiate the process, interested applicants must contact the Regatta Point office directly to receive additional information and obtain the required application materials. At this time, scholarship applications cannot be submitted or processed online.


Eligibility
Scholarships are available to children, adults, and organized groups who demonstrate financial need and a genuine interest in participating in Regatta Point Community Sailing programs. Both full and partial awards may be granted, depending on the availability of funds and the applicant’s level of need. Scholarships are distributed on a first-come, first-served basis.


Application Requirements
Applicants must select a specific Regatta Point program and complete the associated scholarship application form. Required documentation supporting the request for financial aid must be included. Individual applicants, as well as group leaders applying on behalf of their organizations, must ensure that all materials are submitted in full. All applications are kept strictly confidential.


Deadlines
There is no fixed deadline for scholarship applications. However, awards are made on a rolling basis, depending on available funds. It is recommended that applications be submitted as early as possible, as scholarships are awarded in the order they are received.


Award Criteria
To qualify for a scholarship, applicants must clearly demonstrate financial need. This may include participation in a free or reduced lunch program, meeting the income thresholds defined by MassHealth standards or Federal Poverty Guidelines, or other exceptional circumstances as evaluated by the Executive Director or their designee. In addition to demonstrating financial need, applicants must also provide a written statement outlining what they hope to gain from the sailing experience.


Youth Scholarships (Ages 7–17)
Youth applicants must be between the ages of 7 and 17 at the start of the program for which they are applying. Eligible youth may receive a scholarship for up to two sessions of a youth sailing program. Priority is given to youth applicants when allocating scholarship funds.


Group Scholarships
Organized groups interested in sailing programs may apply for financial assistance. Pricing for group programs is determined based on the number of participants, hours of instruction, and equipment usage. Scholarships for group programs are awarded at the discretion of the Executive Director, taking into consideration the proposed program cost and group needs.


Review and Approval Process
Applications may be submitted at any time. All submissions are reviewed by the Executive Director or their designee. Decisions regarding scholarship awards are final. Once a determination is made, applicants will be promptly notified of the outcome. If awarded a scholarship, the applicant must pay any remaining balance in order to confirm their place in the program.


Recognition and Acknowledgment
Organizations receiving group scholarships may be recognized in newsletters, websites, or other marketing materials. Responsibility for publishing this acknowledgment rests with the receiving organization, which should provide Regatta Point with copies of such publications. Individual recipients are encouraged, though not required, to submit a letter of appreciation or testimonial following their participation.


Non-Discrimination Policy
Regatta Point Community Sailing provides equal access to all applicants regardless of race, gender, creed, or religious affiliation. While all eligible applicants are considered, preference is given to youth participants. Scholarships are distributed on a first-come, first-served basis, subject to available funding.


Record Keeping
All scholarship applications are stored digitally in a secure folder, organized by year. These records are maintained to provide documentation of fund allocation. Apart from anonymized participant statements used for reporting purposes, no application materials will be shared outside the organization without explicit permission from the Board of Directors, the Executive Director, or an authorized designee.


Shipping Policy
Regatta Point Community Sailing is committed to processing and shipping all orders promptly. Items will be shipped within two business days of purchase. We select the most efficient shipping carrier for each order, which may include the United States Postal Service (USPS), United Parcel Service (UPS), or FedEx.
Unless otherwise specified, shipping and handling costs are not included in the listed price of the product and will be calculated and added at checkout.
Tax Exempt Purchase Policy


Organizations
Sales to organizations that are tax-exempt under Section 501(c)(3) of the Internal Revenue Code (such as charitable and nonprofit organizations), as well as sales to agents of such organizations. To claim the exemption, the buyer or their agent must provide the vendor with:
 

  • A signed copy of Sales Tax Exempt Purchaser Certificate (Form ST-5) or Contractor's Sales Tax Exempt Purchase Certificate (Form ST-5C), and

  • A copy of the organization's Certificate of Exemption (Form ST-2) issued by DOR. The vendor must ensure that this form is complete and keep it to prove the sale was exempt. Otherwise, the vendor may have to pay the sales tax.

  • Not required but would be appropriate - Exempt Organization IRS Letter. 

 
Government Agencies
Sales made directly to Federal and Massachusetts state or municipal government agencies or entities are tax exempt. To qualify, the agency must be a regular government department, or an entity wholly owned by the government, which exclusively performs governmental duties.
 
If a government entity does not offer an Exempt Purchaser Certificate, the vendor must maintain adequate documentation, generally, a copy of the government check, verifying that the purchaser is a government entity.
 
Additionally, sales of tangible personal property, including meals, to agents of governmental entities, are exempt, provided certain requirements are met. See Administrative Procedure 101: Organizations Exempt from Tax and Sales Tax on Meals for more information.
 
Waitlist Policy
Adults and youth placed on a waitlist for sessions, programs, or camps will be offered available openings on a first-come, first-served basis. For youth programs, once a space becomes available, full payment for the upcoming week must be submitted within 48 hours to confirm enrollment. If payment is not received within this period, or if the offer is declined, the participant’s name will be removed from the waitlist and the opportunity will be offered to the next person.
For hourly rentals, the waitlist operates on a next-in-line basis. Individuals may choose to wait near the rental stand until the desired equipment becomes available. Due to the fast-paced nature of rental operations, Regatta Point staff are unable to call or notify individuals when equipment is ready. It is the responsibility of the waiting individual to remain nearby and check in with staff as needed.


Weather and Inclement Weather Refund Policy
Regatta Point Community Sailing operates programming in a variety of weather and water conditions. Sailing instruction naturally includes both on-water and land-based components, and adapting to changing environments is an essential part of the learning process. When weather or water conditions make it unsafe to be on the water, programs will shift to land-based lessons that reinforce boating knowledge and skills.


Our staff is well-prepared to modify daily activities in response to weather in order to ensure a safe, productive, and enjoyable experience for all participants. While we will make every effort to reschedule or make up any classes canceled due to weather, makeup sessions are not guaranteed. Refunds will not be issued for missed or canceled classes due to inclement weather, and no refund will be given if a participant is unable to attend a scheduled makeup session.
Operating schedule is weather dependent and subject to change. RPCS will make every effort to notify people of the changes via the website. 


In the case of equipment rentals, if inclement weather requires an early return to the dock, the following refund policy applies:

  • Full Refund: Guests who return to the dock having used less than 50% of their reserved rental period may be eligible for a full refund. This will be determined by comparing the time of departure with the time of return relative to the originally agreed rental duration.

  • No Refund: Guests who have used more than 50% of their rental time will not be eligible for a refund.

  • Discretionary Adjustments: Regatta Point shift leaders are authorized to make exceptions to this policy in special cases to ensure customer satisfaction. Guests are encouraged to speak with the on-duty shift leader if they have concerns, and our team will do its best to find a fair and reasonable solution.

The safety and satisfaction of our members and guests are always our top priorities.
Verification of Status (Military, Senior, or Student) Policy
To qualify for a military, senior, or student membership at Regatta Point Community Sailing, proper verification is required. Verification of current or prior U.S. military service must be provided through a valid military ID or a military email address. Student memberships are available to individuals enrolled full-time in an accredited program and require a valid student ID. Eligible students include those in undergraduate, graduate, doctoral, or medical programs. Senior memberships are available to individuals aged 62 or older and require a valid government-issued ID for age verification.
